Store being open at Jumuah time
Question:
AssalamuAlikum,
One brother who has a food business is asking:
“Should he close his business during Jumuah or can he leave his wife or a non- muslim to sell the lunch time food – while he attends Jumuah?”
He attends Jumuah but will receive the income from the sales during the Jumuah period.
The issue is in the part of the ayah: وَذَرُواْ ٱلۡبَيۡعَ. One Mufti deems the income earned during Jumuah to be tainted.
What is the preferred opinion of the Hanafi madhhab?Is this the position even if he is the OWNER of the business?

Answer:
Wa A’likum warahmatullah,
To leave the business running, being the owner, with the Non-Muslim workers and/ or wife is permissible.
Jumu’ah and it’s laws are applicable to those whom it has been made Fardh upon. Hence women and non-Muslims can continue buying and selling without any dislike.
وفي الكلام إشعار بأن من لم تجب عليه الجمعة مستثنى من الحكم كما في القهستاني ( حاشية الطحطاوي)
أما من لا تجب عليهم فإنه لا يجب عليهم السعي، ولا يحرم عليهم البيع (الفقه علي المذاهب الأربعة)
The ayaah which you mentioned makes trading impermissible due to a secondary reason which is the negligence to the Jumuah Salaah by those which it has been commanded upon.
الْبَيْعُ وَقْتَ النِّدَاءِ وَهُوَ أَذَانُ الْجُمُعَةِ لِقَوْلِهِ تَعَالَى: {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نُودِيَ لِلصَّلاةِ مِنْ يَوْمِ الْجُمُعَةِ فَاسْعَوْا إِلَى ذِكْرِ اللَّهِ وَذَرُوا الْبَيْعَ} [الجمعة: 9] أَمَرَ بِتَرْكِ الْبَيْعِ عِنْدَ النِّدَاءِ نَهْيًا عَنْ الْبَيْعِ لَكِنْ لِغَيْرِهِ وَهُوَ تَرْكُ السَّعْيِ فَكَانَ الْبَيْعُ فِي ذَاتِهِ مَشْرُوعًا جَائِزًا لَكِنَّهُ يُكْرَهُ؛ لِأَنَّهُ اتَّصَلَ بِهِ غَيْرُ مَشْرُوعٍ وَهُوَ تَرْكُ السَّعْيِ.(بدائع الصنائع في ترتيب الشرائع)
In conclusion, the etiquette with regard to the reverence of Jumuah, is that it would be better, more desirable and full of more Barakah to abstain from business at that time as the verse states (That is better for you if you only know [Al-Jumu’ah 9]) . However, it is permissible if done.
